Gary Noesner is a former New York City firefighter who was fired by the city in 2012 after he tried to explain his story of being abused by a colleague, the New York Times reported.
The fire department in the city of Buffalo, New York, said Noesners story was untrue.
The city has since reinstated Noesneder, and his attorney filed a lawsuit against the department in federal court in Brooklyn, New Jersey.
A federal judge on Friday denied the lawsuit.
Noesnings story sparked a national conversation about workplace discrimination.
On Tuesday, Noesninger told CNN’s Chris Cuomo that he believes he was fired for lying about being abused.
The New York Police Department said he was a witness to a drug trafficking case.
It said he failed to disclose to his supervisor he was being investigated by federal authorities.
